Question on Collections-Lawyers

I have a local lawyer that has started the collections on an account that is 2 years since last payment. Since they are local firm, I'm assuming the chance for law suit is high? This is for a credit card account. The SOL is 3 years in Kansas, I'm guessing I won't dodge this one for a year.
