They or their assignees will go after the other spouse even if they didn't sign the application or used the card.

Most bad debt buyers and assignees don't have sufficient documentation to determine who is actually responsible for the debt. They will go after anyone with the same last name and address, hoping that someone will pay without knowing any better.

Believe me, I have experienced this. It BITES, I assure you. The OC's will usually go "oops" and go away when someone disputes the debt. The CA's, however, are usually more persistant. Some will even go so far as to threaten legal action hoping that the innocent party will give in.

But if it was truly a joint account and the charges have your name on them, there is nothing to stop them from collecting. The property settlement is strictly between the two divorcing parties and the court.
