Do NOT let them get a default!!! Check the summons carefully. Does it say RETURN DATE? If so, that means you must file your appearance form by that date. If it is an actual court date (which is actually unlikely), you must ask for a continuance in order to file your answer.

If they get a default, they will make an "ex parte" motion to freeze your assets or start procedures to garnish your wages once the judgment becomes final (30 days after the court date).

Fight them and you have a good chance of winning, because they have no documentation on most of the debts they purchase. When was the last time you paid the original creditor while the account was still in good standing? It's possible (probable, even) that the debt is beyond the statute of limitations.

See Why Chat's web site and follow the instructions there. Why Chat posted a link to the site at the bottom of this board under the Newcomer's post. But first, make sure you show up to court and file an appearance so that they CANNOT get a default. And above all, don't admit to anything. It's up to them to prove their case.

I followed Why Chat's instructions and won against MCM, so it can be done. They specialize in terrorizing people with legally uncollectable debt. Don't let yourself be their next victim.
