I guess my moralistic approach to my unpaid debts as well as my lack of knowledge on how the collection process works has created a major problem for me.

When I got my first call from the CA, I returned the call (like an idiot). THEN I got mad at all of their illegal tatics and decided not to be pushed around....
I didn't just call the collector, I e-mailed, called, faxed and sent letters, return receipt requested....to the MAN in charge of the agency, documenting my every move. I also contacted a lawyer about suing for violations of the FDCPA. Well, lo and behold, I got an overnight letter from the CA saying that 'they will contact the OC for veification of the debt.' If they do not receive verification, they will 'close the account and return it to the OC.'

The problem is: I had two accounts with this OC. I borrowed enough to settle ONE account at 23% of the amount owed to keep it from being charged off by the OC. The first account had already been charged off.
In hindsight, I feel like I made a big mistake in settling the 2nd. account as now the OC will expect me to pay the discharged account if the CA returns the debt. Both accounts are recent charge offs...the DOLA is about 2 1/2 years.

I read that you should NEVER request validation of a debt IF it is in SOL.....that is makes the CA sue. Could someone please explain why they sue, considering the violations of the FDCPA? Thanks.
