Why are you using THAT section of the statutes ?? There is no Tortuous injury in not paying a bill ! That section involves property, not a credit card account. The KEY here is the cause of action, which 99% of the time is when you actually BREACHED the agreement. Your 'breach' did not occur with charge-off, it occurred when you went delinquent. Even the credit card companies will write in their pre-charge-off dunning letters that you are in 'breech of the agreement'. You really need to look at WhyChat's site:
