I live in NY and I just received a notice in the mail today from my bank (Manufacturers and Trust) dated 5/20/04 stating that my joint (with my girlfriend)bank account has been frozen (restraining notice)because of a default judgement received by Cohen & Slamowitz agianst my girlfriend with the plaintiff being North American Capital Corporation. The debt amount is 2,792.74 and the frozen amount is double that. We think that the original creditor may be Discover Card or possibly the Utility company (both from several years ago). There is aproximately $1,350 in the account which we deposited yesterday 5/21/04 to cover a double mortgage payment to avoid foreclosure initiation. We'll be in big trouble if that check presents and the bank does not honor it. I have been out of work for several months now and my girlfriend's only income for years has been from Child Support and SSI (she's mentally disabled). My questions are:
1.) Should my bank have told us that there was a hold on the account as we were depositing the mortgage payment?
2.) Can Cohen & Slamowitz take this money if it came from SSI and child support?
3.) Should I try to contact Cohen & Slamowitz to work it out somehow?
Any advise is appreciated!
