I think you should consider filing for BK. They will get their award,no doubt about it. Whether you refuse arbitration or not. The NAF is very biased against the consumer and W&A win 100% of the time. Also W&A run the NAF. They 2 awards aginst me and I have been sued for both of them. The local lawyers/debt collectors they got to sue me are as slimy as they are. I have already filed for BK just to end the harassment from them. We own a house(this is my debt only), and MBNA likes to sue people who own property, and they settle for 80%, and if you don't own anything they will settle for 70%. Screw them, it comes out to much more than what I already owe. Just expect that when they win the arbitration award, they will add on thousand of dollars to what you already owe. They added $3000 to one of my accounts, and $1500. to the other one. NY is not a community property state. Good Luck!
