This may help. We won a case by objecting to the attorney's evidence. The attorney had a credit card agreement, a single line print out of our name & account and one monthly statement. We objected and said that this evidence was inadmissible heresay, even assuming that the evidence qualified as a business record exception to the heresay rule. We claimed that the attorney had no personal knowledge of the account. The judge threw out the evidence and the attorney then had no case. We were within the 5 year statute of limitations.
