These guys will and can file an "arbitration" against you. You can tell them you have nothing, no money, assets, etc. but it doesn't matter - they want that the "judgment" in their favor and most times get it. I wouldn't file bankruptcy yet wait and see. However check out the website for the Federal Trade Commission (www.ftc.gov). There is also a letter that you can send to anyone harrassing you by phone that states that are to cease and desist from contacting you in any form but by US Mail. It is in this letter that you also dispute all or part of the claim (mainly the interest/penalty, etc. tacked on). Send it certified and be sure and sign the letter. Once they receive that letter they can only contact you by mail. This way you can at least answer your phone but I'd still have caller id. They cannot garnish your wages UNLESS they obtain a judgment and then go through the steps.
