Send them a "notice of rejection of arbitration". If they do to you what they (walpoff) did to me over my mbna account they will still file a claim against you in the NAF but who cares? What they use as evidence against you is incompetant(sp). They use a copy of some unsigned mbna agreement that I have never seen and you'll notice on the claim that the last thing they say befor they sign the claim is something to the effect of " i swear this info to be true to the best of my knowledge.". An attorney can't swear to crap! so if they get an award against you it is defective. After they get an award they must still domesticate it by sueing you in your local court and lucky you the California courts have recently ruled that NAF awards are not binding do to the fact that they are statisticly biased toward the claimaint. I haven't confirmed this yet but i've been told that W&A is also the debt collector for the NAF when NAF needs to collect a debt that is a conflict of interest and a big no no. if you like email me and we can speak privatly. sorry about my spelling!
