I was just served with papers from them last week. Never received anything from them before hand. They are suing on behalf of Midland Credit, who bought the debt from Household Bank. They are suing me for $1500 + attny fees.
I had originally disputed the whole thing with Household back in Feb. 2001. My credit card had a $300 credit limit, specifically for the reason of ordering stuff online/catalogs. I ordered clothes, and returned most. Then they kept sending me clothes, I kept sending them back. HOusehold refused to hear my dispute, and the catalog company said I needed to take it up with Household to stop allowing the charges. It got up to $900 on statement I have. (I moved since then and lost most of the staements!!) I continually disputed, no one would listen. My last statement I received in April 2001. The last time I paid was in March 2001.Then in early 2002 they turned it over to Midland. I got a total of 3 letters in a year. The balance was now $1200. I asked for an itemized statement of exactly what they contend I owed, and they refused. I sent letters. Then I heard nothing. Next thing I know, I'm served with papers from Wolpoff & Abramson!
So I filed my Notice of Intent to Defend. (I'm in MD) I also called the Attorney General office, who advised me to call the court and ask what to do, and also to file a complaint against Household, Midland and W&A through the Financial Protection Divsion on MD. I called the court clerk. She said to send a letter attached to the NID asking the clerk to ask for a dismissal on ground it was past the SOL. So I did. In the meantime (I'm new to this!!) I called W&A and spoke to one of their "people". She started asking to verify my address, phone, place of employemnt. When she asked my salary, and I half-mindly answered, I then asked if this was mandatory. She said yes, you're paying this right? And I said "No. I'm calling to let you know I've filed my NID, as well as a request to dismiss." She very indignantly said "On what grounds?" I told her the SOL had past. She asked if I would fax everything I sent to the court, which I told her was certified. She said "maybe we can work something out."
NOT! They never acknowledged my dispute, and the court filing has an officer of Midland stating I never disputed the amount they say. Isn't that a false filing? I also included copies of my CR's showing notes FROM Midland stating "Dispute resolved, customer disagrees." Well, it wasn't resolved because they never contacted me, but right there they admitted I disputed.

I'm defending myself. Maryland usually sides with consumers. Oh, and the AG office also told me to file a complaint with the MD Bar for W&A taking a re-aged account and filing past SOL.

Any other suggestions of what I can do?
