My Account with them is about a year or so old....but Stillman Law Office was the first CA that contacted me. Capitol One are awful and like I said they refuse anything that I offered but they did cash that MO that I sent to them.

I'm prepared to go to court. I have no money in my checking account and I plan on not having any in there when I go to court on Thurs (6/03). As for other assests, I have a mobile home with no equity what so ever and a car that's barely worth anything. I have no savings or anything like that. I'm self employed so they can't garnish anything.

I just need to know the right questions to ask when I get to court. Like: Where is the person from Capitol One? I read that the lawyer can't be a witness for the plantiff. So does Capitol One have to have an actual representative there? Where is the contract that I signed? Do they have to have the original document that I signed? What about my monthly statements? Can I ask for proof showing all my monthly transactions on that account? I know that my balance waa $500 but where did the $800 come from? Can I ask for proof? Does the $25 money order that they cashed play anywhere in this case?

Can someone help me with these questions and maybe add other questions that I should ask?

As you can tell I'm trying to find something that I can use to get the case thrown out!
