Is the card company suing you, or some scumbag preadory collection agency? How old is the debt? When did you last make a payment?
You need to find out if the debt is within SOL or beyond. If beyond, you have grounds for dismissal. If not, do not give up hope.
Just as eighty percent of judgements go uncollected, many answered and contested suits are dismissed, for lack of prosecution.
Answer the suit. The enemy cites 'Counts' against you. Answer each count that you 'Lack Knowledge". You're saying to the court "Let this guy prove his case, whoever this jerkxxx is."
The enemy has gleet-encrusted dreams of Unanswered suits and Default Judgements.By answering the suit, you've denied him Default judgement, something for which he lives his miserable, pointless, empty, existence. Now the attacker has to work, spend time and money proving his point. Money is supposed to flow only one way, towards him. A problem.
Sometimes collectors push an answered suit all the way to judgement, many times they lose interest in you and move on to easier targets.
Being sued isn't merely scary, it's terrifying, especially in light of the build-up by way of calls from nitwit moron bullies and their screaming threats. This is deliberate, designed to keep you off balance, in hope of scaring you into paying. Don't. Ever. Pay them nothing.
Look, these rat-droppings gave you a card and charged high interest, their way of admitting a high-risk decision. OK, so you can't pay back. The card company figures that into their annual budget. Fight them. As for collectors, oh, my, we just love 'collections professionals' on this board. You've come to the right place, we can help you prepare some real nice 'love offerings' for those lovely collections swine.
