Update: Being Sued

Talked to two lawyers last week. One (I was referred to by pre-paid legal firm) told me that if he were me he wouldn't hire him... Use the money to help pay off the debt. The other was with the pre-paid firm. He seemed to think that the lawyer can work something out for us.

As I said I live in Texas and I have wondered why a Texas lawyer on behalf of Bank of America(knowing this is a debt friendly state) would file a suit... Maybe you can help me here with that thought.

Another statement by the same lawyer (I was referred to him by pre-paid legal services and I am a tiny member) ... He said that a lawsuit is "lots of work" on his part, and I had to reply that if it's hard work on his part what in the world does he expect a layman to do? I know nothing about this kind of thing.

So... I will pay him to get this matter straight and will be on his back to make sure he does it too. After reading so much in this Forum I know and have tons of information but not the confidence to take care of it myself.

I mentioned earlier that I also paid DEBTXS almost 3,000 bucks to help me and Bank of America ignored them. The lawyer told me that he has heard of this company and if creditors work with them -- it works.

I was not behind on my payments when I decided to contract with them .. just wanted to get lower interest rates and settle down the road. I was a fool. The money I spent on DEBTXS and now a lawyer would have already paid off one credit card.

Live and learn. I have faith in our system and until I am proven wrong will work with both parties.

We have been in our home for 22 years, bought the lot behind us (which is NOT part of our homestead and is still owned by the bank), have a car (not paid for yet) and more. We have just a few years left on all. Before this happened I had decided that it was time to pay off all cards. I keep two for emergencies but will not use them unless that is the case.

I will protect what we have worked hard and long for. I am 60 and my husband is 61 so screwing up and not taking care of it now could make a big difference on how we live when we retire.

What happens once the papers are sentback in (my 20 days is up next Monday)? Does my lawyer talk with the one that filed the suit? I am assuming that is what will be done. Where after that do we go ...down the road? Until my lawyer has his retainer fee in his hands he will not tell me more. I also know that everytime I talk to him I am being charged so most from me will be in writing or faxed to him.

There should be a Forum for implusive buyers because that is what I decided I am...
