I was sued and immediately contacted my attorney. I was sued by a CA, who violated FDCPA, and one that I could have probably successfully defended against. Didn't know then what I know now. That would have been a whole different ballgame. However, I thought I knew what a bankrucpy would be. I thought I knew the exemptions. I did know the most important exemption for me. Tenants by the Entirety. In my state, if the debt is invididual, and the homestead is owned jointly, the homestead is safe from lein. I own a home with my husband. Getting back to my lawyer experience. Was hard to get in touch with him sometimes, sometimes I was annoyed because I did not feel that he answered my questions to my satisfaction. BUT, the end result was excellent. He did it right, he knew a copule of VERY LITTLE things that I did not know, and those little things saved me money. So, in the end, when I recieved my discharge in the mail(never had to see a judge)
I made a phone call to my attorney and this is the message that I left. "I received my discharge today, and you are on my list of heroes." My exact words, so I guess that says it all. I have to add that the attorney suggested the bankrupcy because it would be the easiest and cheapest way to go. My husband was paying the attorney, so he wrote the check for the bk, and I did not object.
