I was hoping to gain some more (and great advice) from WHY CHAT or any other.

On April 16th I was handed a "Summons" via personal service. This document was for an old account in the late 90's which I thought was either real or not - it had not court file number and was from a debt collector who is also a law firm (Specializing ifn aggressive Collections). I did not think it was real and thought is was an attempt to haggle me for what I think is a SOL debt. WHY CHAT advised me to see if it was real and suggested it might be an old aged - re- upped attempt - but that I needed to see if it was real.

WHY CHAT suggested I call the court to see if it was a real summoms. I did that 29 days after the original service. Nothing according to clerk. I have since checked the computer at the courthouse twice, and as late as 38 days after service - nothing - no court file with my name.

Then, a few weeks ago, I did recieve via mail a letter from the law firm/collection agent, an affidavit "By Mail" a affidavit and request for hearing of collection fees and a general description of what costs are related to typical collect. It was stampted by a notary public.

They asked me to sign and return or I COULD face judgement for more than that amount. I have not signed or returned for fear for them hounding in more. In fact, I have ironically moved and I received via forwarded mail.

WHY CHAT or anyone, does this sound like an old aging and scare tactic into me settleing? Would they not need a court file if the summons was real? Either upon successfl service, or anythime within 20 days, or what has now been at least 38 days?

Any idea's suggestions or advice would be Greatly Thanked!
