One of the biggest tricks collectors try to use is confusing documents that may mean nothing which are notarized often by their own people.

It is important to review the document carefully and possibly have a lawyer look at it to be sure, but do NOT do what the collector demands just because it "looks" legal and is notarized.

My sister works in the billing (collections) department of a hospital in NY and she as well as all her co-workers had to become notary publics.
Gee, I wonder why.

As to "being served" its amazing how many people are "served" with unfiled lawsuits, that is they are served first and then the lawyer/collector does not send it to court. Again, you need to be sure of this, as you appear to have done several times, but people should not be suprised if they find nothing exists in their local civil/supreme/small claims court even though the collector may claim to have filed. Sometimes the collector is waiting to hear back from you when you call them terrified that it has escalated to this level. Usually at that point you are willing to give them all the info they need to decide if they should go ahead with the actual suit or not.

My name is not "BeenThereStillDoingThat" for nothing. I have had several collectors attorneys "file" suits which to this date have never appeared in any court. The attorneys call all the time warning to call them right back to handle this matter, but months pass and nothing is in the court as of yet. They may show up one day but so far they have not. This is not done by just a few bad attorney/collectors, it is very widespread.

As everyone says here NEVER TRUST A COLLECTOR.
