They have to sue and get a judgement before they can seize a bank account. It is just a matter of filing the proper paper work with the bank and court. (I don't really know the legal procedure) Sometimes people have judgements against them that they do not know about. These are usually judgements by default. The defendent (debtor) did not show up in court. That can be because he was served at an old address. Of course they need your banking info.
