basically means both wife & husband are equally responsible for debts & property .. an example is if your in a comm property state but only 1 spouse signed a credit application both spouses are still equally responsible for the account but in states that are NOT comm property states like ALABAMA well only person who signed the application is responsible but sometimes IF the other spouse charged on the card that can SOMETIMES make them also responsible if the creditor challenges .. another example is filing BK , in your state its easy for only 1 spouse to file BK ( BUT that depends on alot meaning if other spouse never signed any applications & such ) but in a community property state BOTH spouses MAY have to file reguardless if the other spouse is on account or not but every situation is a lil different .. theres only appx 9 states in the U.S.A that are comm. property but ALABAMA is NOT a community property state , most of them are out here on the west coast the only 1 in the south east is louisiana .. like i say alot depends on creditors & every situation is different .. hey hope it helped alittle , bye , kelly .........
