Hi all, Ive been sued by Asset Acceptance for a SOL expired Providian debt in WA state. I responded (on time) with an appropriate SOL defense and now the attorney has filed for a summary judgement hearing. Heres the good part. Their motion for summary judgment includes requests money for additional accounts NOT LISTED (Mont. Wards CC account has "magically" appeared in the request for summary judgment) in the original complaint. Essentially they have altered their case without notifying me or the clerk. I guess they are hoping I, and the jugde, wont actually READ the paperwork and will just sign off on it. WhyChat, is this adding of additional accounts mid-case without proper notification legal? or have they really screwed up on this one? Anything in specific I ought to complain to the judge about? I really wanna put the screws to this crappy CA attorney. Thanks!
