I have been in that exact same court house and stood up for my rights. I WON. I won because the CA had insufficient proof and they knew it. They won't fight you if you stand up to them and are prepared.

The first date you are given is nothing more than a return date to file your appearance. If you don't file an appearance, they *will* win without a doubt! A few weeks later they will have another hearing to get a default judgment against you and ask for an "ex parte" motion to garnish your assets.

Now tell me....how is it not worth $120 to stop them in their tracks? If they freeze your account, you will have bounced check fees and no access to your money. The bank will charge you considerably more than that just to handle the garnishment orders they get from the court, plus they'll put you in ChexSystems to ensure you don't open another account anywhere else. And you'll still have to pay a fee to the court just to get your account unfrozen or deal with the consequences of a default judgment.

If you are truly judgment proof, get Legal Aid to assist you! That's what they are there for. And in the meantime, file an appearance form just to keep them from getting a default judgment. Ask the clerks for help, because if you are truly unable to afford the fee, they have a special program to allow you to sue or defend as an indigent person!
