Company, W.Va. settle complaint over DirecTV debt collections

Published June 8, 2004 CHARLESTON, W.Va. -- A collection agency has agreed to refund more than $67,000 that it obtained from DirecTV customers in West Virginia to settle complaints filed with Attorney General Darrell McGraw's office. Jesse L. Riddle, doing business as Riddle & Associates, P.C., of Draper, Utah, also agreed to stop adding attorney fees or collection costs to any future debts collected in West Virginia, McGraw said Tuesday. Eric Wilson, a Charleston lawyer, filed a complaint against Riddle while a student at the Appalachian School of Law in Grundy, Va., in March 2002. Wilson had received a letter from the company seeking payment of a bill that it said he owed to DirecTV. His complaint questioned a $98 charge for "Attorney/Collection Cost," McGraw said. Wilson's complaint and others prompted an investigation by McGraw's office. "Consumers should always be wary whenever a company seeks to collect more than the amount that is legitimately owed. West Virginia law prohibits a debt collector from adding collection or attorney fees to the amount owed in virtually every circumstance, except in the collection of delinquent educational loans," McGraw said. He said DirecTV has closed all the 4,651 West Virginia accounts that were given to Riddle for collection and canceled more than $760,944 in debts.
