Excellent material on your website, Why Chat. However, in reading the statute, it looks to me like sec 1179 authorizes disclosure of PHI for "reporting to consumer reporting agencies". And it looks to me like 45CFR164.506 allows the disclosure of PHI without consent (except as noted in 164.508).

I think the key to your letter and my misunderstanding is contained in this paragraph, quoting from your website:

"Generally, once it is determined that a covered entity may use or disclose PHI, it must take reasonable measures to limit the use or disclosure to the minimum amount necessary to accomplish the intended purpose of the use or disclosure."

Are you saying in that paragraph that a covered entity must delete the CRA report once they have received payment? If so, do you have a reference in the statute or regulations that I can refer to?

Keep in mind, I am not a lawyer, only a lowly debtor. Any insight is most appreciated.
