I did a voluntary reposession of a car back in 1995. In 2001, in an effort to pay back the debt I paid $2000 on $5100 to a CA. In 2002 when it was time to send more checks, I didn't have a job so I told them I wouldn't be able to make any more payments. Recently I was contacted by another crdit agency trying to collect the debt. I asked them for something in writing on the debt and after much going around an around they agreed to send it. I never affirmed to them I owed the debt. The SOL for Massachusetts where the loan was orginiated is 6 years. Can I send a Cease and disist letter based on SOL?
