It depends on your State.
If you are in a "cause of action" State like NY & Mass. (and MOST States) then a partial payment doesn't count, as you are still in default, UNLESS the creditor has agreed to accept the partial payment and bring you up to date.

In SOME States, like Ca. a partial payment(TO THE OC) DOES extend the SOL as it is a "last item" State.
