Eskanos & Adler sent me a letter telling me that I owed money to Citibank Credit card. Well I'm pretty sure this is a very old Master Card account I had with Home Savings that I had to stop paying in 1997 because I was on workers compensation and the adjuster illegally cut off my disability payments. It was several years before my comp case was settled. I am 100% disabled and collect social sercurity. I wrote to Eskanos & Adler explaining that this debt was seven years old that I had never had a CitiBank card nor had I ever applied for one. I also pointed out that this debt was well beyond the four year Statue of Limitations and that threatening to sue over a debt that is beyond the statute of limitations is a violation of the Fair Debt Collection Practices Act. I sent this let by register mail so I know that they received it. Of course I can’t find the slip. However they chose to ignore my letter and have sent me a summons. So what is my recourse? This is Ssven years old and I no longer have any paperwork from so long ago. Not to mention Home Saving is no more. Oh yeah they reported that I owed Citibank as if this was a new debt! So how do I go about proving this?
Please help
