Sears can't take you to court anymore because they sold the account. Your account has been bought by a collection agency. If Sherman decides to take you to court, they do so in this manner. They try and get a judgment without your knowlege. Thus, if and when they start to contact you, keep logs and keep all paperwork. Go to your credit report and have all old addresses removed. They like to serve people at old addresses so that they won't know they are being sued. Sherman likes the easy win, the no-show default win.

Sears is also really stingy on their paperwork which means that when they sold your account, they probably did not sell the required documentation with it. Sears and other big creditors are now charging debt buyers (collection agencies, or acquisitions recievable firms as they like to call themselves) so much per page of paperwork. Many of the debt buyers cannot afford to buy the paperwork to prove their case as they usually are required to buy portfolios which consist of thousands of accounts.
