I am sure someone out there has gone through or is going through the same thing I am. So, here is my story......

I have been divorced for three years. In our divorce papers, my ex agreed to pay off all marital debts listed on our financials, by taking out a second mortgage on his house. I also had added that I would not be responsible for any debts incurred under his name or under his companies name, no matter how my name was used in any capacity. Well, you guessed it, he didn't pay them off and didn't take my name off the accounts. (I was just a card holder on his accounts, because I was his wife.) He ended up filing Chapter 7 bankruptcy in April 2003. Starting in October,2003, collectors starting calling me for payments. Two of the three accounts wrote these accounts off due to his bankruptcy, but one will not budge. I have sent all divorce papers to the collector. I have proven to them that he did not claim this credit card on his bankruptcy. They took his name off the account and moved mine to the primary card holder (again, I was only a card holder, not a signor). The collector told me that divorce papers from Colorado are not legal in Missouri, where they are collecting from. The account was opened in Colorado. So, if anyone has gone through this same thing, please help and answer some of these questions (before I spend my whole savings on a lawyer)

1. So, I know I should contact a lawyer, but wanted to get some insight from other people who have gone through the same thing first.

2. Can my ex add more debts to his bankruptcy a year after he filed? It was finalized in September 2003.

3. Is it legal to move my name from just a card holder to primary account holder without my permission?

4. Are divorce papers legal and binding? no matter what state the collector is in.

5. I have not received anything!!!! in the mail regarding this debt.....and they won't send me anything about the charges (this would prove that I never used this card, that the charges were all my ex's) Do the collectors have any obligation to prove to me the debt?

6. ANY COMMENTS WILL BE SOOOOO APPRECIATED!!!!!!!!!!!
