Midland Credit Management (not OC) has just filed a lawsuit against my husband on an aquired cc debt ($1,900.00)that is still within Mo state SOL. He also has a wage assignment(same as garnishment) for court ordered child support and the court order mandates he maintains health insurance and half of any deductable and copay for his 14 year old son from his first marriage. The child support and mandated insurance comes to 20% of his monthly net income. For the last 2 and a half years he has been the sole support of our household, hence the reason why we are in default on this debt. He is and has been current on his child support for over 9 years and until I am gainfully employed again we can not pay the rest of our bills, child support, insurance with deductable and copay, this one debt in default, and still afford food. He makes too much money to qualify for food stamps, so their are no other options available to us. We live in Missouri. Can anyone see any answers for our dilemma that doesn't include BK, we are buying our home? The pre trial conference is 7/7. He is the sole repondent in this lawsuit and on the cc that is in default.
