If it is a business account, consumer credit laws don't apply. Yes, it is legal for them to do an inquiry on your credit report and to even place it on your personal credit report if the account is in your name and has your social security number. It does not matter if the account is business or personal as far as credit reporting goes. The account goes under the name of the person whose name is on the account.
