Suing a credit card company

I have looked at the FTC website to see if my husband and I are able to sue, and I think we might be able to, but I thought I would find some information first. I emailed someone else for advice too when I put in a google search for "suing a credit card company". So basically what happened was we went to a consolidation company to get help with a high credit card amount with Direct Merchants. The consolidation company worked with them and DM was supposed to change the date of reciept of payment and they didn't so it resulted in 2 delinquent payments going to the credit bureau resulting in my husband's credit rating plummetting about 100 points. My husband has recieved a letter from DM stating that they have recieved his dispute and they are rectifying the credit report. It is supposed to be off his report in 3 months. It has already been 2. But when all is said done it has hindered us for the past 4 months to get any kind of decent equity loan from our mortgage company. It has damaged his credit report and caused undue anguish on our part. Are we able to sue the credit card company for damages? Thanks.
