First and foremost B&M are evil. Thats it. Keep this in mind. They will do everything they can to terrify you and WILL threaten to sue you and WILL claim to HAVE sued you even if they didnt. I know this personally. I also know other people who have had this happen to them from B&M. Now that doesnt mean they wont sue, but they are well known for breaking the law over the phone and making statements that are untrue. B&M are located in upstate New York, so if you are out of state they cannot legally sue you, they would have to get a third party to do it. Thats not likely as CACV probably would have sold/sent it to a attorney in your state rather than NY. If they smell money in your case they might try to go through other parties to get to you but its possible you had something in New York once and thats why they got your account. I am not a lawyer and not offering legal advice but I would NOT get into any kind of deal or payment plan with them. If possible do not answer their calls or letters. If they claim to sue you be sure to check your local court house AND do not call them back unless you get proof they have sued. Many "attorneys" for collectors will claim to have sued or that they will sue but will not because of cost and time involved if they dont think they can collect. You will have to be careful with them and be sure of where you stand , however they are very likely to use scare tactics to get you to either get into a payment plan which is risky because they can stop it and drain your bank account OR they can try to get you to agree to a default judgement by promising you something they will not follow up on. Just be careful no matter what you do. These are very mean spirited people and do not care what your situation is.
