I think I posted too early in the morning. Here' a bump...

I had a rough spell after the 'dot crash' and simultaneous divorce but I want to clear this up now. I have paid in full most of the old debt and I'm ready to buy a house but I can't just pull the leaches off...they need to be burned off. RJM has been reporting this on TRANSUNION and EXPERIAN for some time now. I did dispute this via the EXPERIAN Web site but they say RJM verified that the account was valid which I believe it is not.

WHAT I KNOW:
*** RJM is reporting to EXPERIAN and TRANSUNION (based on a 3 bureau report given to me by the Veterans Administration)
*** They are trying to collect from 'Dave' instead of 'David' when I do not go by Dave and have never signed any documents or filled out any forms ever with the name 'Dave'
***This might be from a Bally's Fitness account that I transferred to HHLD back in 1999

For some reason I have old notices from RJM but nothing recent, (I suppose I have been shredding on a more regular basis). I have uploaded 3 demand letters from 3 different entities that were sent within 5 months of the first all claiming to be either the new creditor (RJM) or collecting for the new creditor. I did block out most identifying info to protect myself.
Here is the URL: http://www.gasfreeze.com/credit

A couple of questions:
***Do I need to wait until I receive a newer demand letter to pursue the next action? (30 days to respond rule)
***What procedure should I follow now? I have included a copy of a validation letter I modified from creditinfocenter.com down below (SEE BOTTOM OF POST).
***Is this where I start?
***Is there another letter I should write or perhaps other info I should be asking for?

I appreciate all the help here. I’m going after these guys first and then a couple more leaches once I get the process down.

Thanks again,
David

To Whom It May Concern:

This letter is being sent to you in response to your letter, (COPY ATTACHED). This is not a refusal to pay. This is notice that your claim is disputed.

Under the Fair Debt Collections Practices Act (FDCPA), I request validation of the debt you claim I owe with proof that:
1. I am indeed the party you are asking to pay this debt
2. There is some contractual obligation which is binds me to pay this alleged debt
Please attach copies of:
•Agreement that bears the signature of the alleged debtor wherein he agreed to pay the creditor.
•Any insurance claims that have been made by any creditor regarding this account
•Any judgments that have been obtained by any creditor regarding this account
-Any past, present and future correspondence to any and all credit reporting agencies regarding this matter.

Furthermore, please provide the following:
-Original Creditor's Name:
-Name of Debtor:
-Address of Debtor:
-Balance of Account:
-Date you acquired this debt:
-Was this debt assigned or purchased?

You should also be aware that reporting such invalidated information to major credit bureaus might constitute defamation of character, as the negative marks on my credit report harm my credit and prevent me from enjoying all the benefits of good credit. I'm sure your legal staff will agree that non-compliance with this request could put your company in serious legal trouble with the FTC and other state or federal agencies.

Regards,

David
