At some point, I imagine a lawyer will find the time and resources to pursue this issue up the court system and establish some case law on the subject.

The problem is time and money. Even if you were guaranteed to win, appealing a case through the system is expensive and time consuming. Appeals court requires lots of documentation (they usually don't hear testimony) and lengthy briefs arguing your position. Perhaps someone will start the process and have the will to follow it through.

It certainly does seem unreasonable that someone can go into court and collect 100% of a "alleged debt" that was purchased for less than 1%. Perhaps they should get triple their cost and court fees. After all, the original creditor already got the tax benefit from writing off the debt.
