You would be correct for an INITIAL hearing , however this thread is dealing with a motion to VACATE.

In a motion to vacate a default judgment, improper service is a VERY BIG part of the claim, however, it must ALSO be claimed that the debtor would have had a VALID defense IF he had been given proper service.
