We might sue the Consolidation Company

This is regarding some posts that I put up here before, and you can refer to them if you want.
My husband found some things out when he spoke to the credit card company and the consolidation company too.
First of all the guy that he originally spoke to at the consolidation company no longer works there and he assumes he was fired because of the way the lady he was talking to was acting when he mentioned his name. So this guy never told my husband that the first payment went into escrow with them, and never made it to the credit card company, and then the agreement with the credit card company was probably not processed properly by him because the credit card company did not know to change the date of receipt of payment making the other 2 delinquent charges reported to the credit bureau. Which makes for 3 late charges on his credit report.
I don't know how long it takes for this to be cleared of the report, but because it is obviously not the fault of my husband, I hope there is something we can get from it all. It certainly is jeopordizing us getting a home equity loan that's for sure.
How long does it take to clear off the report anyhow?
Hopefully if my husband nicely tells the consolidation company if they don't come up with a good solution to the boo boos, then he will sue.
