I would not pay them anything until you have a written settlement agreement. It sounds like you had a settlement conference with the judge and could not agree to terms with MBNA. MBNA does not compromise much. You might want to contact the attorney and see whether he has a counter offer as to what MBNA will settle for.

Otherwise, you can go to trial and force MBNA to bring a live witness. MBNA may not be able to get someone and then you should win.
