If you are in a tenants by the entirety state, or a state that protects your homestead, you don't have to divorce your husband. You should look at your state exemptions before you do anything. If you are saying that you will divorce your husband so that you are judgement proof, why not just let him have everything in his name. What state are you in, and do you have a judgement against you yet?
