Stay married, assets in his name. Establish Family Limited Partnership; him as general, you as limited partner. A bit expensive to set up. Once you do, assets are protected. Creditors don't want to attach an LLP, as they become liable for their share of IRS taxes. You declare 'phantom profits' of, oh, a million or two. Let creditors slurp that. You owe nothing.
Sounds as if you're exempt anyhow. Elaborate maneuvers, i.e. divorce, in anticipation of future bills you can't pay, may cause trouble with Fraudulent Transfer of Assets statute. Google "Badges of Fraud". You may lose your protections if Badges of Fraud are detected.
Remember, whether doing crimes or good deeds, simplicity is best. Example, distant 'relatives' of this worthless writer were after the estate of an elderly relative. They've been at it years, slyly staying out of sight. A patient death, or two, is involved. They got rich. They expect to become richer. Their cloven-hooved bloated-tick whelps expect to become richer still; at expense of surviving relatives. I'm a surviving relative. This just won't do.
Now they're caught, howling, threatening, whining to anyone who might protect them. Why? I researched these protozoans, reported my findings to interested persons and agencies. Just as we do on this board with CA piggy-plops.
It's not so much their actions, it's efforts to cover their tracks that left a glowing trail. Moral of our little tale? Simplicity. Complex maneuvers may be impossible for others to follow, but they'll smell something wrong.
The vain poofter lawyer at bottom of this family insect pit wrote me a 'love offering, trying to scare me off from further reporting. Can we spell 'fear'? Surely we can smell it.
Which brings us to another sunny point. Any trouble you have with collectors, no matter how slight, report it here. Tell cops, BBB, FTC, State AG, the Bar, your physician. Light sends cockroaches, silverfish, aphids, doot-flies, and leeches packing. Want CA's to back off? Tell others about their 'good deeds'.
