Okay now I need to sue...

Here's the deal. My husband has asked the consolidation company to release him from the program on the advice of a wonderful person at Centex that was honest to us that I was referred to by catb on this forum. The consolidation company will give us this letter for the release of him from the program, but seeing as they did not get what they wanted from us that initial payment that is in escrow, will not be given back to us. We were promised in the beginning that it would not damage our report and us being stupid agreed to it all and believed them and of course it did. So now because of this we want to sue. The original person that he spoke to there in November no longer works there and we believe he may have been fired, this man did not tell him the truth of it all. Should we and what do we do to do so?
