Does judgement proof mean......./What's in it for the attorney?

Does judgement proof mean that the attorneys won't bother filing suit because they feel there are no assets to take?
Even if they realize that you're with no assets, do they still decide to file suit, or is the decision to file already made by the bank, with no option for the law firm to reverse the bank's decision?

Does the attorney get a flat fee from the bank, or do they get a % of what's collected after a judgement? Perhaps a combination? What's the typical fee or % ?
