Here you go: Important caselaw: http://www.dca.ca.gov/legal/dc_2.pdf page 26 notation 81 Kimber v Federal Financial Corp Proof of California 4 year SOL: http://community-2.webtv.net/Y-Chat/WhyChatsCredit/page6.html California FDCPA violations: http://www.dca.ca.gov/legal/dc_2.pdf page 9 Article 2.6(2)(8) page 10 Article 2.7(5)(6)(11) page 11 Article 2.8(3) FDCPA violations: http://www.creditinfocenter.com/legal/FDCPA.shtml 807(2)(A) 807(4) 807(5) 807(8) 807(10) 808(1) Civil liability: statute 813 You will, of course, have to print and look these up yourself. You need to file a $2000 countersuit against them(1k for fdcpa and 1k for cali fdcpa) and any damages you have received. When you go to court make sure you have each count down on paper and an explanation to yourself on what it means. Find the Kimber case and research it as it is widely used. Get the SOL statutes down. IF you have any questions email me at picanteL4343@hotmail.com. Ask others on the board who know more about filing sanctions against these scumbag firm and be sure to file complaints with the california attorney general, the FTC, and the bar association in their city(file an ethics complaints). DO NOT have any mercy on them because I guarentee they will have none on you. GET you money from them. MAKE your complaints. DO NOT let them get away with this or they will go after easier victims.
