My name is Dave -------- and I am turning to you as I don’t believe there is anyone else that has the authority to review the practices of Primary Financial Services of Phoenix, AZ. I am in the process of paying the last required payment from a debt in which they have refused to give me any information on. I have no idea who is claiming that I owe money and they have refused to tell me. Being a recent college graduate I don’t have the financial resources to hire a lawyer and so under constant documented threat and bully tactics I have reluctantly agreed to pay $1,231.00 for a account that I have been told is delinquent, even though Primary Financial Services has refused to tell me who has contracted them to collect. Upon further research I have found countless examples of unfortunate individuals who have had similar experiences with the afore mentioned firm. I have documented no less than 17 incidents of illegal harassment (12 of which were threatening phone calls coming after the hours of 10:00 pm and before 7:00 am) in which Primary Financial Services has violated Colorado State Protection acts; please refer to CSR 5-6-103 for explanation of Colorado State laws. In addition to these violations Primary Financial Services has contacted my employer without me ever volunteering such information and asked them for details about my wages. Upon being told that they were not entitled to such information without my consent the Customer Service Representative for Primary Financial Services threatened my employer with legal action; after being laughed at and hung up on they continued to harass my employer until legal action was threatened by my employer against Primary Financial Services, at which point they simply resumed harassing me with repeated calls that numbered up to four and five voice messages on my answering machine per day. I will make my final payment on July 1st and have been told that I will receive detailed information on who it was who contracted Primary Financial Services to collect upon my “delinquent” account. Upon further research I have found that it is typical for this particular firm to make such promises, however, I have yet to see a single example of where this was passed along. It seems to me that this particular firm makes of habit of constantly violating the State Laws of the consumers they are hired to collect upon. With most of their business coming out of state, it doesn’t seem that any type of federal torts have worked to counteract the practices of this firm. These bully tactics that are employed by Primary Financial Services is simply unjust. I have little doubt that I could have stopped the harassment and illegal acts had I had the financial resources to hire an attorney. After reading many other examples of this particular firms practices, it seems to me that they look for people who can’t defend themselves in order to close a higher percentage of collected accounts without having to worry about legal ramifications behind their actions. I would urge anyone with any type of authority over Primary Financial Services and its industry cohorts to review their practices the experiences of those who have been caught up in the unjust, illegal and immoral bully tactics used by Primary Financial Services and their ilk. If you have any questions I have phone records and witnesses who witnessed Primary Financial Services participation in numerous illegal acts and I am more than happy to share such information in pursuit of justice against these financial pirates.
