Payday Advance Loans included in BK?

Does anyone have any advice on how payday advance loans are treated when you default and then intend to put them in your BK. We had a few that were automatically deducted from our checking account. The rate is like 500% and we could not pay them and they ended up overdrawing our bank account and then the fees and all...next thing you know we closed the account. One or two of the CA are trying to say these are worthless checks and that we can be prosecuted (class 4 felony) and arrested. We live in FL and from what I have found if you post date a check or if the payee knows the check is not good when you give it to them, then you can't be charged criminally. If anyone has any info I would appreciate it. Thanks.
