I guess employers can pay as little as they like, though if the net pay ends up being less than the state or federal minimum wage it would be illegal. The employer seems to be trying to get the employees to discourage customers from using credit cards and pay with cash instead. Kind of a strange practice. What he should do is realize that a certain percentage of customers are going to use credit cards and adjust prices and/or wages accordingly across the board to compensate for the bank fees. Profits may increase anyway despite the bank fees because sales volume will increase. New customers should be coming in that weren't there before because they didn't have enough cash. The credit card companies do not like a store doing anything to discourage card use. They probably have something in their agreements to prohibit such practices. You should also report this to Mastercard and VISA and whatever other cards the store grudgingly accepts.
