The payday loans can definitely be included in your BK - its just another unsecured debt. IF they sue and win and can PROVE criminal intent - which is doubtful - then the debt would not be discharged.

These payday loan places all need to be outlawed, IMO. They have been outlawed in many states. They will pursue you aggressively and here in TN they will sue people, but that doesn't mean they get anything at all except the civil penalties.
