Long story short - I was sued, owed money, didn't go to court [stupid - I realize that now]. Default judgment awarded. Contacted law firm - payments arranged on amount owed plus court costs, etc. Judgment was awarded. I've been paying since November 2003. Own home - have savings account but want to pay monthly. Retired on disability - receive SS and disability pension. Savings account is settlement from workmen's comp - for injury. I cannot remove the money from this account - for reasons I cannot explain here. Please understand. I can check my court case online. I found this yesterday: 06/28/2004 MEMORANDUM OF CREDITS FILED IN AMOUNT OF $1,387.30 06/28/2004 MEMORANDUM OF INTEREST FILED IN AMOUNT OF $218.49 06/28/2004 MEMORANDUM OF COSTS FILED IN AMOUNT OF $27.00 06/28/2004 WRIT OF EXECUTION ISSUED TO CONTRA COSTA COUNTY IN THE AMOUNT OF $5,513.33 The credits they are claiming are much lower than what I've paid. I'm calling them about that. That isn't my major concern. As I have the ability to look at other court cases, online, I've been trolling cases similar to mine. I've noticed that a 'Writ' always seems to be awarded in any default judgment - and normally, years later, it is either returned as satisfied or unsatisfied. Now my question: Is this just a 'normal' process in a default judgment? In my case - they get a Writ to protect themselves if I stop paying the monthly payments? OR - are they going to try and raid my bank accounts - if they can find them? They will have to do a good search to get to them. [I've posted before about them - never used these banks to pay on accounts, no bad checks, do not have any CC's or loans associated with the banks] This is a law firm I'm paying - I've researched them -and I've had not problem dealing with the people there. Thank you for your time.
