I just got served with papers today to be in court on Thurs morning.

I had a joing credit card acct with my ex. In our divorce settlement, it states that I am to pay all car repair charges on said car. It does not state anything else about the remaining balance. My atty assured me it was just the car repair charges that needed to be paid. Done. Paid it all about 4 or 5 years ago.

Well, ex decided to not pay anything AT ALL on the remaining balance. Acct went into collections. Collection agency filed a judgement against the both of us. (being it was a joing acct)

So, I called the collection agency, and made arrangements to pay 1/2 the balance, which I'm still doing and have been current with.

Now, ex is suing me for what the collection agency is going after him for.

I no longer have proof of what I paid or even the amount of what my charges were. I mean, this was years ago. I figured I didn't need it anymore.

Anyway, I called the collection agency to try and get copies of all of that. They claim they have none? The guy states that all he has was the last date the credit card company was paid and balance due.

So, my question is, what the heck happens when we go to court on Thurs? I thought these people were suppose to keep records of all that stuff?

Where do I go from here to proove that I already paid above and beyond my portion of this bill?
