Why are you questioning your lawyer ?? HE's RIGHT ! Wachovia has violated the permanent injunction of the BK discharge and that is illegal and actionable.

(The automatic stay is only in effect until your discharged, then it becomes a permanent injunction against collections of ANY kind.)
