FCC & FTC rules have a changed a lot over the past 10yrs to try and keep up with technology.

Generaly Speaking, No company could say they have a right to incur costs on a consumer in an uncontroled way. ie harassing the consumer at work, or any place that the consumers time = money, or calling a pay-per-use phone without the consumers consent.
